In early January of 2021, the Department of Labor finalized a new Independent Contractor Rule that would have made life easier for club leaders and their independent contractors (e.g., yoga instructors, fitness instructors, massage therapists, etc.). However, in May of 2021 that rule was withdrawn by the new Administration.

 

Now, club leaders find themselves more at risk than ever before when dealing with independent contractors. Indeed, a less sympathetic Department of Labor and the coming "ABC Test" will soon expose clubs to significant penalties under the Fair Labor Standards Act and the Internal Revenue Code for misclassifying their workers. To avoid this, club leaders must begin now to understand the coming changes and how to deal with them.
